Bay State Hauling – Terms & Conditions

1. Services Provided
Bay State Hauling (“we,” “our,” “us”) provides junk removal, hauling, and related services to residential and commercial clients in Massachusetts. We remove most non-hazardous items, but reserve the right to decline removal of certain materials (see Section 4).
2. Estimates and Pricing
- All estimates are provided free of charge and without obligation.
- Final pricing is based on the volume of items loaded into our truck, measured at the job site.
- Our Price Beat Guarantee applies only to written estimates from licensed, bonded, and insured competitors with responsible disposal policies.
- Discounts cannot be combined unless specifically stated in writing.
3. Payment Terms
- Payment is due in full upon completion of services, unless otherwise agreed in writing.
- We accept cash, credit/debit cards, and approved checks. Returned checks may incur additional fees.
- Any unpaid balances may be subject to late fees and collection costs.
4. Prohibited Items
We do not remove:
- Hazardous waste (chemicals, solvents, paint thinner)
- Flammable or explosive materials (gasoline, propane tanks, fireworks)
- Medical waste (needles, biohazards, pharmaceuticals)
- Asbestos or asbestos-containing materials
- Pressurized containers (unless fully empty and depressurized)
- Items prohibited by local, state, or federal law
If prohibited items are discovered during loading, we may refuse removal and/or adjust pricing for additional handling requirements.
5. Access and Safety
- The customer must ensure safe and reasonable access to the removal site.
- We are not liable for delays caused by blocked access, unsafe conditions, or inaccurate descriptions of items.
- Our crew reserves the right to decline removal if it poses safety risks.
6. Damage Waiver
While we take every precaution to prevent property damage, the customer acknowledges that moving large or heavy items carries inherent risk. Bay State Hauling is not responsible for pre-existing damage or damage resulting from unsafe site conditions.
7. Cancellations and Rescheduling
- Cancellations or rescheduling requests must be made at least 24 hours before the scheduled service.
- Late cancellations may be subject to a fee.
8. Limitation of Liability
Our liability is limited to the total amount paid for the specific service provided. We are not liable for consequential, incidental, or indirect damages.
9. Governing Law
These Terms & Conditions are governed by the laws of the Commonwealth of Massachusetts.
10. Hold Harmless & Indemnification
The customer agrees to indemnify, defend, and hold harmless Bay State Hauling, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to:
- Injuries to persons or damage to property resulting from unsafe, hazardous, or concealed conditions at the service location.
- Inaccurate, incomplete, or misleading descriptions of items or conditions provided by the customer.
- The presence of prohibited, illegal, or hazardous items not disclosed prior to service.
- Actions or omissions of the customer or any third party at the service location during the performance of our work.
This indemnification obligation applies whether such claims are made by the customer, the customer’s guests, agents, tenants, contractors, invitees, or any third parties, and remains in effect after the completion of services.
